1. General Provisions
1.1. This User Agreement (hereinafter — the «Agreement») is an official and public offer by the Anna Heal team (hereinafter — the «Administration», «Service», «We») to conclude an agreement on the terms set forth below with any fully capable individual who has reached the age of 18 (hereinafter — the «User», «You»).
1.2. The Service provides services using artificial intelligence (AI) technologies. It is important to understand that the Service does not replace an in-person consultation with a licensed psychotherapist, psychiatrist, or clinical psychologist and does not provide psychotherapy services in their full scope. The Service is intended for informational support, self-reflection, and development of self-help skills.
1.3. Acceptance of this offer is considered to be the User's performance of any of the following actions: starting interaction with the bot, using any function of the Service after reviewing this Agreement. By accepting the offer, the User confirms that they have fully read and agree to all terms.
2. Age Restriction
2.1. Use of the Service is permitted only to individuals who have reached the age of 18.
2.2. By starting a dialogue with the Service, you confirm and guarantee that you are 18 years of age or older. The Administration is not responsible for the inaccuracy of age information provided by the User.
3. CRITICALLY IMPORTANT INFORMATION: DISCLAIMER
3.1. IMMEDIATELY STOP USING THE SERVICE AND SEEK EMERGENCY HELP IF YOU ARE EXPERIENCING:
- Thoughts of harming yourself or others.
- Suicidal thoughts or intentions.
- Symptoms of an acute panic attack, deep depression, severe anxiety.
- Any other crisis or life-threatening conditions.
3.2. The Service is NOT INTENDED and CANNOT be used to provide assistance in crisis and emergency situations. Artificial intelligence is not capable of adequately assessing and responding to such cases.
3.3. IN A CRISIS SITUATION, IMMEDIATELY CONTACT:
- A crisis or suicide prevention hotline in your country (e.g., 988 Suicide & Crisis Lifeline in the US & Canada, 116 123 for Samaritans in the UK).
- A licensed psychotherapist, psychiatrist at the nearest medical facility.
- Emergency services (e.g., 911 in the US, 112 in many EU countries).
3.4. The Administration IS NOT RESPONSIBLE:
- For decisions, actions, or inaction of the User taken based on information received from the Service.
- For the accuracy, completeness, timeliness, or usefulness of responses generated by AI.
- For any direct or indirect consequences arising from the use or inability to use the Service.
4. Confidentiality and Data Processing
4.1. We undertake to protect your personal data and the confidentiality of conversations. However, due to the use of AI technology and the Telegram platform, we cannot guarantee the absolute confidentiality inherent in face-to-face communication with a psychologist.
4.2. We may collect and process the following data: the text of your messages, metadata (time of request). This data is used solely for the functioning of the AI and improving the quality of the Service.
4.3. We undertake to maintain the confidentiality of your conversations, except in cases provided by law:
- Upon receipt of explicit information about a threat to the life and health of the User themselves or other persons.
- Upon an official request from authorized state authorities.
5. Intellectual Property
5.1. All rights to the Service, its design, logic, database, and generated content belong to the Administration.
5.2. The User grants the Service a non-exclusive license to use the text of their messages for processing by AI and improving the Service's operation. All data is anonymized and not used to identify a specific user.
6. Final Provisions
6.1. The Administration reserves the right to amend this Agreement unilaterally. Notice of changes is posted within the Service. Continued use of the Service after changes are made constitutes your acceptance of them.
6.2. This Agreement shall be governed by and construed in accordance with the laws applicable in the jurisdiction of the Data Controller, with due consideration given to principles of international data protection (e.g., GDPR where applicable).
